Texas's supreme court has said that it is constitutional to charge someone that is civilly committed with a third degree felony for failure in therapy. This is outlandish and completely contrary to the constitution. First it can never be proven that a person will commit another crime. It is very questionable if it can even be proven that one is likely to. Nevertheless, if a psychologist says that this person in his program is not advancing or if the person refuses treatment, which is a constitutional right, then Texas will charge this person with a third degree felony. Some have received life sentences! A mentally retarded man was put in prison for calling his mother, because she was not approved. The sad part is that sex offender recividism is so unlikely, yet these people are sitting in prison and may have never committed another crime in their lives.
DOES THE UNITED STATES EVEN HAVE A CONSTITUTION ANYMORE?
WHO IS NEXT? WHERE WILL THIS END? SURELY YOU DON'T THINK THEY WILL STOP WITH SEX OFFENDERS!

Faulty test
By Does anyone know how the magazine's like Elle and Red Book, I think is another one, who put out the quizzes that ask a bunch of questions and the score is totalled to see if you are an intimate lover or a cuddler or whatever the thing is that is sought, kinda entertaining, yet really not accurate. This is surely not scientific.
These are the test psychologists are using to incarcerate people for the rest of their lives. They are called actuarial test. The recividism rate of sex offenders is 5.3%, so they are using the fact that someone else answered questions in the same manner to get up on the stand and say that a certain person is so much of a percentage to be in the 5.3%that will reoffend.
There was a study in Minnesota on the STATIC99R and the findings were that it was only 25% accurate at showing high risk offenders. This prompted other studies. One in Florida showed about the same as the one in Minnesota. Then international studies started and they showed that the static99r was only good 1out of every 90 times. Check out Karen franklin blog.
These test and the past actions of these people are the only evidence of any future behavior. That being said if these test can't predict recividism then these people, citizens of the United states who have finished their prison sentences, are being incarcerated once again for the same crime! There is no proof one will reoffend, never was and never will be!
The psychological industry tried mass hospitalization back in the 60s and they are using the same ruse here on an easily exploited group.
politicians lies
The state is allowing the psychiatric industry to use inflated statistics to dupe the public into believing that certain individuals need to be "civilly committed", because they are are "likely" to reoffend. The irony of the situation is that the ones applying the inflated statistics are the ones who are being allowed to profit from this new age form of servitude. The recividism rate for a sex offender committing another sex crime is only 5.3%, yet the state has over 300 individuals committed in this program. Over 60% of these have been sent back to prison over rule violations. It is interesting to note here, that these rules are not felonies passed as laws through legislation, yet they are being used as laws for this lower class of citizen.
This program is said to be outpatient, yet these individuals are clearly incarcerated. This is being done to allow the state to avoid certain obligations that comes along with incarcerating a person. These people are kept from contacting loved ones. It's said that only approved contact is allowed, yet this approval takes months and even years, when it is done at all. At least one, in this state sponsored new age caste system, has been sent back to prison for calling his own mother!
